Article 1 - Purpose and Scope
These General Terms and Conditions of Sale (GTC) define the rules applicable to sales made via the website www.maisonysance.com.
They apply to any purchase made by a consumer or non-professional residing in one of the countries served by Maison Ysance.
Validation of an order implies full and unreserved acceptance of the GTC in force at the time of purchase.
Maison Ysance reserves the right to modify the GTC at any time. Modifications will only apply to orders placed after they are posted online.
Article 2 - Product Characteristics
Maison Ysance offers a selection of decorative items, small furniture, textiles, lighting, accessories, and home ambiance objects.
Each product is presented with a detailed description including:
– dimensions,
– materials,
– colors,
– weight,
– manufacturing specificities,
– care instructions.
• Specifics of artisanal pieces:
A number of products offered are:
– handmade,
– manually patinated,
– made from natural materials (wood, stone, linen, cotton, plant fibers, etc.).
Variations in shape, texture, knots, colors, or patina are inherent to this type of manufacturing. These irregularities do not constitute a defect or a reason for automatic refund.
• Photographs and renderings:
Images are for descriptive purposes. However, colors may vary depending on screens, photographic lighting, or dye lots. These variations cannot under any circumstances engage the responsibility of Maison Ysance. Furthermore, ambiance visuals may be AI-generated staging. Products comply with contractual descriptions and photos.
• Availability:
Products are offered within the limits of displayed stock.
In case of unavailability after the order, Maison Ysance will contact the customer to:
– offer a replacement,
– or proceed with a refund for the unavailable item within 7 business days.
Article 3 - Prices, Taxes, and Environmental Contributions
• Prices:
Prices are indicated in euros. Prices do not include shipping costs, which are charged extra according to the customer's choice.
Maison Ysance may modify its prices at any time.
The applicable price is the one displayed at the time of order validation.
In accordance with the provisions in force relating to VAT exemption, prices are exclusive of VAT. The mention "VAT not applicable, article 293 B of the General Tax Code" is included on the invoice.
Article 4. Order and Validation
To finalize an order, the customer must:
1. select one or more items
2. fill in contact and delivery information
3. choose the delivery method
4. choose a payment method
5. accept the GTC
6. proceed with secure payment and then the pickup location if necessary
A summary email confirms the order registration.
Maison Ysance reserves the right to:
– refuse an order in case of doubt about its authenticity,
– cancel a purchase in case of payment default,
– refuse an order in case of a previous dispute.
Article 5 - Payment
Payments are made via:
– credit card,
– PayPal,
– or secure digital solutions (ShopPay, Apple Pay if offered).
Payment is debited immediately and processed by certified providers.
No banking data is stored by Maison Ysance.
Article 6 - Delivery
• Delivery zones:
Maison Ysance delivers to:
– metropolitan France,
– European zones displayed during the order process.
• Lead times and processing:
Orders are prepared and handed over to the carrier within an average of 24 to 72 business hours (excluding weekends, holidays, and public holidays).
Delivery times depend on the selected carrier.
• Receipt and inspection:
The customer must check the condition of the package upon receipt.
In case of damage:
– precise and detailed reservations must be written on the carrier's delivery note,
– one or more photos of the damage must be provided,
– the packaging must be kept,
– Maison Ysance must be informed within 48 hours of receiving the package.
In the absence of precise reservations made at the time of delivery, no damage related to transport can be compensated.
• Unclaimed delivery:
A package returned for:
– non-collection,
– wrong address,
– inability to deliver
may be re-shipped at the customer's expense.
Article 7 – Right of Withdrawal
In accordance with articles L221-18 et seq. of the Consumer Code, the customer has a period of fourteen calendar days from the date of receipt of their order to exercise their right of withdrawal, without having to provide reasons or incur penalties.
• Products excluded by nature:
In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot apply to the following products:
– personalized or custom-made products at the Client's request
– products unsealed after delivery and which cannot be returned for reasons of hygiene or health protection
– products that have been used, damaged, or are incomplete
– any product returned without its original packaging or without the delivery note.
• Terms of exercise:
To exercise their right of withdrawal, the Client must inform Maison Ysance by email at the following address: contact@maisonysance.fr
Items must be returned:
– in their original condition,
– perfectly clean,
– in their original packaging.
Return shipping costs are the responsibility of the Client, except in case of an error attributable to Maison Ysance.
• Refund:
The refund will be made within a maximum of fourteen days from the receipt and inspection of the returned products, subject to their compliance with the above conditions.
Article 8 - Product Returns
In the event of receiving a broken, incomplete, or non-conforming item to the initial order, Maison Ysance will require the transmission of photographs to verify the defect.
After verification, Maison Ysance will proceed, as appropriate, to:
– an exchange,
– or a refund.
Any item returned without adequate protection or that has suffered damage during return transport will not be eligible for a refund.
Article 9 – Warranties
• Legal guarantee of conformity:
In accordance with articles L217-3 et seq. of the Consumer Code, the Client benefits from the legal guarantee of conformity for goods sold by Maison Ysance.
This guarantee applies to defects of conformity existing at the time of product delivery and appearing within two years from that date.
In this context, the Client may request, free of charge, the repair or replacement of the non-conforming product, subject to the conditions provided by law.
• Legal guarantee against hidden defects:
In accordance with articles 1641 to 1649 of the Civil Code, the Client also benefits from the legal guarantee against hidden defects.
This guarantee covers hidden defects rendering the product unfit for its intended use or diminishing its use to such an extent that the Client would not have acquired it, or would have paid a lower price for it, had they known about them.
• Implementation procedures:
Within the framework of legal guarantees, Maison Ysance undertakes to propose the most suitable solution to the encountered situation, which may consist, depending on the case, of:
– product replacement,
– a price reduction,
– or a refund.
Article 10 - Customer Service and Complaints
For any questions or complaints, the customer can contact: contact@maisonysance.fr or fill out the form provided for this purpose on the website.
Maison Ysance strives to respond within 48 to 72 business hours.
Article 11 - Mediation
In case of a dispute between the customer and the company, they will endeavor to resolve it amicably (the customer will send a written complaint to the professional or, if applicable, to the professional's Customer Relations Department).
Failing an amicable agreement or in the absence of a response from the professional within a reasonable period of one month, the consumer customer, as defined in article L.612-2 of the Consumer Code, has the possibility to, free of charge, if a disagreement persists, refer the matter to the competent mediator registered on the list of mediators established by the Commission for the evaluation and control of consumer mediation in application of article L.615-1 of the Consumer Code, namely:

Article 12 - Liability
Maison Ysance cannot be held responsible for:
– non-compliant use of the product
– natural or artisanal variations
– color differences due to screens
– carrier delays or losses
– consequences related to external or unforeseeable events
– indirect or immaterial damages.
Article 13 - Personal Data
Maison Ysance processes customer data for the following purposes:
– order management,
– shipping,
– invoicing,
– customer support,
– internal statistics,
– commercial information (with consent).
The customer has rights of access, rectification, opposition, deletion, and portability.

Article 14 - Intellectual Property
All content present on the website and in Maison Ysance documents (including texts, photos, videos, logos, graphics, layouts, and staging) are protected by copyright, trademark law, and intellectual property.
Any reproduction, representation, modification, publication, transmission, or total or partial exploitation of this content, by any process whatsoever, is strictly prohibited without prior written authorization from Maison Ysance.
Any violation of these rights may result in civil and criminal proceedings, in accordance with articles L335-2 et seq. of the Intellectual Property Code.

Article 15 - Force Majeure
Neither party shall be held liable for non-performance or delay in the performance of its contractual obligations resulting from an event of force majeure as defined by law and jurisprudence, including but not limited to bad weather, natural disasters, fires, strikes, pandemics, epidemics, health restrictions, supply disruptions, or any other unforeseeable, irresistible, and external event.
In such a case, Maison Ysance may suspend or cancel the order, without the customer being entitled to any compensation.
If the force majeure event extends beyond 30 days, each party may terminate the contract by right, without compensation.
Article 16 - Applicable Law and Jurisdiction
These general terms and conditions of sale are governed by French law.
In the event of a dispute relating to the interpretation, execution, or validity of these conditions, the parties will endeavor to reach an amicable agreement, possibly through mediation.
Failing an amicable agreement, the dispute will be brought before the competent French courts.
Article 17 - Environmental Information and Sorting
Maison Ysance is committed to complying with regulations related to the circular economy and waste reduction, particularly the AGEC law.
Sorting instructions and mandatory logos are indicated on the packaging of the products concerned as well as on their descriptive sheets.
